Here is another update on my appeal: (Hopefully this is the last one before my big envelope...) I've been pestering VA every week through every avenue I can think of - calling the 800# and my VSO, sending messages through IRIS and having my congressman's VA rep make official inquiries on my behalf. This Monday (19SEP11) I got an email forwarded from the congressman's office that my appeal would be done in 10-15 days. Today (23SEP11) I called my VSO at the Legion and he said my appeal is done! According to him, my file is in 'authorization' and should be available next week. I know not to get too excited yet. Its just hard to believe the waiting and stress on my marriage might almost be over - unless I'm denied again - which will likely cost me my home, car, and what sanity I have left... Thoughts anyone?

Try to stay cool about this. As they say, "Hope for the best, but expect the worse." I'm frankly going to think positive for you. I know you've been round the bush with this long enough now. Do keep us posted. Crossing my fingers, eyes and toes for ya.

How much difference a day makes... Checked my email late last night and found a pair of emails from my congressman's office. One was a note commiserating with me for the denial of my appeal and the second was the denial letter from VA. The decision letter that I won't hear about until next week says they denied Gerd, GI symptoms due to undiagnosed illness, Restless Leg Syndrome due to undiagnosed Illness, skin rash on scalp, tension headaches, and tremors. They did grant me 40% for Fibromyalgia so if I'm using the hadit sc calculator right I will see an increase from 80% to 90% (yay...) but that is all. They completely ignored the fatigue issues I claimed (point #2 in my NoD). The SoC omits all reference to CFS and related symptoms... the formal appeal will take me what, another two years or more?

I got my Decision letter AND the direct deposit for my back pay today! The VA 'awarded' me 40% for fibro AND 40% for CFS - still not enough to raise me to the 100% mark (Comes out to 92.9 something with VA math) - but its better than nothing. I'm still going to appeal the decision - I feel like they lowballed me on the CFS (60% instead of 40% would put me at 100% too). My wife and I talked about how many days I am bed ridden from fatigue and guesstimated its well over the 6 week criteria for the higher rating. Elapsed time from filing to decision: 2 years 10 months 23 days!
